Dallas County DWI Case Reduced to Lesser Charge

November 5, 2013

Our client Javier was charged with Driving While Intoxicated (DWI) in Dallas County.  His breath test score was 0.09, which places it just above the legal  limit in Texas.  Additionally, there were significant issues surrounding the legality in which his vehicle was stopped for suspicion of drunk driving.

The case was set for a jury trial and as the trial date approached we were able to use these key issues in the case to strengthen our negotiating position with the Assistant District Attorney.  Eventually the DWI case was dismissed and re-filed as an Obstruction of a Roadway, which is a less serious criminal charge.
